| Fake gun license case | | Court issues arrest warrants against SDM, Ors | | EARLY TIMES REPORT
Jammu, March-05 :- Today the police filed an application in the fake gun license case scam titled State Vs Mukhtiyar Ahmed choudhary SDM Mendhar and Ors who were booked u/s 420/467/468, 471 RPC r/w section 3/25 Arms Act seeking arrests warrants of Sub-Divisional Magistrate Mendhar & Ors on the ground that they are not cooperating with the investigation team.
Special Mobile Magistrate Passenger Tax Jammu YP Kotwal after hearing Chief Prosecuting Officer Mr. Pawan Khajuria and also gone through the CD file said that Court is satisfied that accused are not cooperating with Investigating Agency and their arrest is necessary for the investigation. Upon this Court issued arrests warrants against Mukhtiya Ahmed Choudhary Sub-Divisional Magistrate Mendhar, Qasim Hussain clerk in the officer SDM and Mohd Yasir Qureshi with the direction to police to arrest the accused and investigate the case and they be produced before Court also.
It is worth mentioning here Qasim Hussain s/o Fazal Din one of alleged accused in the fake gun license scam has filed pre-arrest bail application before the court of 2nd Additional Sessions Judge Jammu. Court called the report and perused it and observed that accused is involved in Fir NO 18/2011 and is alleged to have committed offence u/s 420/467/468, 471 RPC r/w section 3/25 Arms Act. He is alleged to have procured illegal Arm Licenses by being an employee of the Revenue Dept in connivance with Yaseer Qureshi and SDM Mendhar Mukhtiyar Ahmed Choudhary after charged hefty amount from the innocent people to whom they used to supply said licenses and the guns and there is apprehension of said licenses and guns may have gone to anti-social elements. According to the report the applicant is absconding.
The 2nd Additional Sessions Judge VC Koul after considering the objections filed by the APP and opposed the bail application, the counsel for the applicant submitted that he does not want to press this bail application and prayed that the same be rejected. Upon this Court dismissed the bail application as withdrawn. JNF
