Jammu, March 5: Senior PDP leader and former Deputy Chief Minister of J&K Muzaffar Hussain Baigh hit back at BJP on the remarks of ‘Muslim fundamentalism’ vehemently contending such ‘brandings and labeling’ would neither force the community run away from the realities nor would make them less Indians. Baig also contested legally what he termed as BJP rhetoric on Article 370 as also the assertion that rulers in J&K were dependent upon the Centre’s aid and funds, saying stae would need no ‘help’ from New Delhi if it was allowed to utilize and exploit its own resources of water and power.
“ We are not cowards …..we are not beggars……if anyone is under that impression let them understand this well that whatever New Delhi gives to us is far less than what state would accrue from harnessing its own natural resources the benefits of which are enjoyed partly by Pakistan and party some other states of the country”, Baigh said in a high pitched tone while speaking on the motion on Governor’s address in the Legislative Assembly today.
The PDP leader, who as always was in his oratory best, termed as unfortunate the system which was adopted by the then rulers on account of which J&K has been deprived of benefits and denied access to utilize its river waters. “It is this system which has resulted in economic dependence of the state……..Hame Pani Ka Paisa Deejiye ….Teen Dariya Ka Pani bahra Istemaal Ho Rahaa Hai……( give us our waters and power back and neither Omar Abdullah nor Mufti Mohammad Sayeed will have to need charity…….I assure you if that happens they will not go to New Delhi with begging bowl…”, Baigh asserted in a contesting tone, dismissing the impression that the rulers of the state go to New Delhi with begging bowl. He maintained J&K would need no help from centre if it was allowed to exploit its own water resources fully.
A legal luminary, while giving detailed historical perspective and legalities linked with Artilce 370, former deputy Chief minister Muzaffar Hussain Baig said there was no way that the Article 370 could be done away with without snapping the constitutional ties between the state and the union. Discounting BJP claims and cry for abolishing the article 370 from the Indian Constitution, saying they were totally ignorant of the legalities of the issue and are misleading the people. He said the provision existed in the State much before independence. He further said the President of India can abrogate the article 370 only on the recommendations of the constituent assembly of the State which no more existed, meaning the act can't be scrapped.
Earlier, while giving elaborate details on the need and necessity to have sepcail status, Baig said Kashmir had been at the receiving end of unfair, discriminatory and at times inhuman conduct of the powers that held it through force ever since the Mughals occupied it. Be it the Mughals, Afghans, Sikhs or Dogras, Kashmiri Muslims were treated no better than serfs and slaves, the policy of apartheid practiced in some other parts of the world looked more humane than the treatment meted out to the Muslims of Kashmir who incidentally were them selves part of a glorious and out standing 5000 year old civilization.
Baig said in recognition of these facts it was decided at the time of accession that the state would retain the authority to accept or not any future constitution of India and obviously this was to be determined through a constitutional process of debate, dialogue and consensus. It was through that constitutional process that the article 370 was introduced into the constitution by our founding fathers.
Quoting from the constitution of India Baig said it was wrong to say, as the BJP does, that Article 370 was a hurdle in relations between the state and the centre. Contrary to this he maintained, that it was only because of the Article 370 that Jammu & Kashmir had a constitutional relationship with the union. He said the Article had virtually assumed a permanent status as it could be scrapped only through a resolution by the constituent Assembly of Jammu & Kashmir which had ceased to exist since.
Condemning the malicious and insensitive expressions by some members that branded Muslims of the country in a particular color Baig said “We are as much the stake holders of India as followers of any other faith are”. He said those who make remarks about Babar being the ancestor of Indian Muslims, he wondered how the nearly sixty crore Muslims living in India, Pakistan and Bangladesh could be the progeny of one person. The fact, he said was that Muslims are equal stakeholders in India and adoption of Muslim faith does not disqualify them in any way from that rightful claim.
