Chaman reacts to PDP statement on Art 370 | | | EARLY TIMES REPORT JAMMU,Mar 6 : The leader of the BJP Legislators Party Prof Chaman Lal Gupta has ridiculed the assertion by certain interested quarters that Article 370 of the India Constitution cannot be abrogated and if it was done the lone bridge between the State and rest of India would be broken. ``This was high misleading and misinterpreting the factual position,’’ he added and pointed out that very inclusion of this Article has been there as “Transitional and temporary”. Sharply reacting to the statement of PDP leader, Muzzafar Hussain Beig and some others that Article 370 cannot be abrogated because it needs approval of the State Constituent Assembly and this body has ceased to be there, Prof Gupta said that if it was taken so, then the things have become more easier for the President of India to issue a simple notification in this regard. Prof Gupta pointed out that the relevant portion of Article 370 reads. “Not with standing anything in the foregoing provisions of the article, President may by public notification declare that this article shall cease to be operative. Even the founder of Article 370, Prime Minister Jawahar Lal Nehru has assured the nationalist leaders of the country, including Moulana Mohani and others that Article 370 is a temporary provision and would wither away with the passage of time. The BJP leaders said that it was astonishing to say that it is longer bridges to link it with India. But the Article 370 which is being termed as a bridge between this State and rest of the country had come into being in 1950 whereas the State of Jammu and Kashmir has acceded to Indian Union in 1947 under the law of the land. This means the State was part of Indian Union much before Article 370 even without this so called bridge. It is height of misleading the factual position. Jammu and Kashmir had come to be an integral part of India like other States the day when the Maharaja Hari Singh had signed the Instrument of Accession October 26, 1947. Prof Gupta said that separatism and semi-separatism in Kashmiri is an off shoot of painful communal division of India in 1947 and the protagonists of Article 370 as also that of autonomy, self rule or even that of Azadi are infected by the virus of this very obnoxious Two Nations Theory and by raising such slogans they want to create Three Nations Theory to distance this State form rest of the country. ``But if the Constitution can be good for over 120crores of other Indians how it can be the separatists should join hands with the people of entire country not only a few lakhs of Valley alone to make amends,’’ he added.
