Court accepts VOJ closure report | | | Early Times Report Jammu, March-08 (JNF):- The Vigilance Organization after investigation a case against former Executive Engineer R&B BD Khajuria then posted Basholi filed a closure report in the court today. The accused was accused of misusing his official position and conferred favour on his wife Mrs. Chanchla Devi by allotting contract to her @ 1.1 % below sanctioned scheduled rates of 2004 when a similar work was allotted by the same officer @ 55% below sanctioned scheduled rate. The investigation was carried out and during investigation the Investigating Officer ventured to assess the assets of suspect also. Ultimate conclusion of the IO was that there was no evidence to establish that the suspect officer committed any violation of rules and what was done by him was in accordance with the procedures laid down. The conclusion led to closure of the case. Special Judge Anticorruption Jammu AK Koul today while accepting the closure report observed that the record has been perused carefully. The allegations against the accused was that he conferred pecuniary benefits in favour of his wife by allotting contract for construction of sulari link-road to her but during investigation it was found that the wife of the officer is an A-Class contractor and she participated in the bidding process and having been found the lowest tender. The contract was allotted to her. This on the face of it does not invite any panel action unless some ulterior motive established. As per the details of the investigation the IO could not find any think to prove the tender documents were manipulated in any manner or that the officer committed any gross violation of terms of tender notice. Nor, is there any evidence to suggest commission of any other offence by the suspect officer. That being so this Court has no reason to differ with the opinion reached at by the Investigating Officer. With these observations court accepted closure report filed by the VOJ after investigation of the case more than three years. JNF JNF/MARCH/08/2011/3
