| Mahant, ors denied pre-arrest bail | | Sale of Temple property | | Early Times Report
Jammu, March-08 (JNF):- Special Judge Anticorruption Jammu AK Koul rejected the pre-arrest bail application of Mahant Ram Milan Dass and his Chela Darmodar Dass (nephew of Mahant) of Mandir Shri Ram Janki Pracheen Mandir Udheywala who are allegedly involved selling the land Mandir. The High Court passed in 1989 commanded the Mahant that he is only the custodian of temple property and is no case should be treat as his personal property. That apart civil court on August 22, 2010 through a decree restrained Mahant from alienating, transferring or handing over possession of the land of temple to any one. These order being enforced, the petitioners have shown complete disrespect to the said orders and have leased out the land to different persons against whose consideration. The matter does not end there only. The land apparently appears to have been leased out but on going through the contents of lease deeds, it appears that it is a complete alienation and not the lease because the ownership rights have been conveyed to the lessees and the Mahant deposited the money received by selling Mandir’s land deposited in his personal accounts.
CPO Parshtom Sharma appearing for the Vigilance Organization submitted before the court that a detailed investigation is necessary to ascertain the extent of involvement of the petitioners and their co-conspirators, the public servants and granting pre-arrest bail in favour of petitioners at this stage is sure to frustrate the process of investigation.
The Court while rejecting the pre-arrest bail observed Custodial interrogation is important feature of the investigation and in serious crimes like the one attributed to petitioners granting pre-arrest bail would means indulgence in the power of police to conduct investigation and rejected the pre-arrest bail application of Mahant and his Chela.
