Court rejects pre-arrest bail in fake gun license scam

Jammu, March-10 (JNF):- The 2nd Additional Sessions Judge Jammu Vinod Chatterji Koul today dismissed the pre-arrest bail application of one Parshtom Singh s/o Mohan Lal r/o Gandhi Nagar Jammu alleged agent in the much publicize fake gun license scam.
According to the police case that on February 7, 2011 Janipur police laid Naka at Roop Nagar at about 10:45 PM found two persons on foot and 12 bore single barrel Gun in their possession and on enquiry they produced the license of the Gun issued by SDM Mendhar, they disclosed their names as Mohd Nasir and Mohd Rafiq of Kotranka, Budhal and in the license the address of the license holder at same place were shown as Kupwara, Budhal Kotranka, Budhal & Kathua which created suspicious and on further enquiry they stated that for procuring the license and the Gun they did not produce any document but were procured license by them after paying money to Bittu, Subash, Chain Singh & Purshtom applicant who got same prepared. On this commission of offence u/s 420/467/468/471 RPC and 3/25 Arms Act were found to have been committed and registered FIR No 18/2011 and investigation was started.
The statements of witnesses were recorded and licenses were seized from the possession of Mohd Nissar and Mohd Rafiq. Accused Chain Singh s/o Inder Singh, Subash Chander s/o Duni Chand were taken into custody and during enquiry it was found that Chain Singh, Subash Chander, Ranjeet Singh and Parshtom Singh (applicant) were working as agents in Tehsil Kotranka and they are charging Rs 30,000 to 40,000 for procuring and issuing gun-licenses and guns. They in connivance of Mohd Qasim s/o Mohd Din and Yaseer Qureshi s/oMohd Azam obtained licenses from the office of SDM Mendhar and on the basis of said licenses purchased the Gun from shops dealing with the sale of guns and after purchasing the gun provide the same to the people from whom the money is collected. Mohd Qasim and accused Yaseer Qureshi is said to have connection with the people dealing with the sale of guns who after procuring the guns sell the same at higher rates to innocent people along with the replaced licenses and both these clerks get said licenses prepared by Mukhtiyar Choudhary SDM Mendhar.
During the investigation it has been found by the police that SDM in connivance with his clerk Yaseer Qureshi and Mohd Qasim has obtained large amount of money and has issued numbers forged licenses on the basis of which numerous guns have been sold, such guns can also be in possession of the enemies of the country.
The Court after hearing both the sides observed that the allegations are serious in nature, the way in which licenses have been issued by the accused, the SDM have accumulated unaccounted wealth for such licenses, the fact that accused is absconding the investigation is to be conducted as to whom the accused as issued the licenses for the matters which shows that custodial interrogation of the accused required and justified. With these observations Court dismissed the pre-arrest bail application filed by Parshtom Singh. JNF
