High Court issues additional direction for rehabilitation of physically challenged

High Court of Jammu and Kashmir with Chief Justice Mr. Justice B.A. Khan and Mr. Justice Bashir A. Kirmani in coram in the PIL titled Javaid Ahmad Tak v/s State of J&K and others has passed additional directions as under:
“The Secretary to Government, Social Welfare department J&K, is directed to take necessary steps for convening meetings of State Level Coordination Committee and State Executive Committee at least once in three months to review the status of implementation of various plans, policies and programmes for welfare of disabled persons;
The Secretary’s report also shows that there are 36,714 children in age of 6-14 who have been found highly handicapped and physically challenged and whose special needs are required to be attended to. Of these about 4000 are said to be having impaired vision and an identical number suffering from hearing disability. As on today, there is no educational facility for them by way of any separate schools or schools for blind, deaf and dumb. It would be, therefore, worthwhile to consider setting up of such schools firstly in the cities of Srinagar and Jammu. The Secretary, Social Welfare department and his two Directors are, accordingly, directed to take steps for establishment of these schools in the cities in the first instance and also to examine and explore possibility of setting up of similar schools at suitable locations in each district of the State thereafter;
There are complaints that the proposals submitted by the State government to the Ministry of Social Welfare Justice and Empowerment, Government of India are going unattended and similarly various schemes provided for by the Ministry are neither known nor are being effectively implemented. The Secretary to Government of India, Ministry of Social Justice and Empowerment is directed to accord consideration to all pending proposals of the state government on the subject and to ensure accord of consideration and clearance thereof expeditiously. He is also directed to take necessary steps to make public various schemes which are available for physically handicapped and challenged persons in the state and to cause filing of status of implementation of such schemes through any competent authority before this Court one week in advance before the next week in advance before the next date. He is further directed to provide details of any funds provided to NGOs operating in the state and also the activities undertaken by them and to provide a similar list to the Secretary to Government, Social Welfare department, J&K for his information and /or any monitoring which may be required.
There are complaints also against Deputy Commissioners and Chief Medical Officers sitting over cases of payment of pension to disabled persons even though the same are cleared by Social Welfare department. All Deputy Commissioners and Chief Medical Officers in the State are directed to dispose of all pending cases of payment of pension to disabled persons within two weeks from receipt of this order and show compliance. Each of these authorities shall submit undertakings before the Court that no such case will remain pending with them for more than two weeks after its receipt by them from Social Welfare department. Copies of this order shall be sent to Directors, Health department, Kashmir and Jammu who shall in turn endorse the same to the CMOs in their respective jurisdiction and obtain their compliance reports to be collectively filed before this Court by the respective Director with their own status reports showing pendency of such cases with the CMOs and their status supported by affidavits.
All concerned authorities shall file their respective compliance/status reports one-week before the next date fixed in the case. Register Judicial to dispatch/fax copies of this order to all concerned authorities immediately and seek their compliance.
