Court acquits youth allegedly involved in grenade attack on police | | | EARLY TIMES REPORT Jammu, Mar 15: Third additional sessions judge Pawan Dev Kotwal today acquitted a youth facing trial in a grenade attack on police at at Ghati in Kathua in 2003. Fareed Ahmad, son of Ghulam Hussain of Kishtwar was accused of throwing a grenade on a police party on September 2, 2003. The court acquitted him, giving him benefit of doubt. On September 2, 2003, Fareed and his accomplices -- Titwal Bhaderwahi, Khuda Ulla Pakistani, Mansoor Pakistani, Afbaz Pakistani and Uzfa Pakistani -- were alleged to have thrown a grenade a police party of Kathua and Raj Bagh police stations at Ghati, resulting in the death of SPO SPO Rajneesh Singh and injuries to cops Narinder Kumar, Parshtom Singh, Darshan Kumar and Surjeet Singh. While police could not get any clue to the whereabouts of others, Fareed was arrested in Kishtwar after some time of the Ghati incident. Kotwal observed that the identification parade was allegedly conducted after more than five months from the date of the incident and there was no link evidence collected by the investigating officer as to how the involvement of the accused in the incident had come to light, especially in the absence of anything mentioned in the statements of witnesses. Admittedly the offences alleged to have been committed by the accused carried punishment to the extent of death penalty or life-imprisonment and the prosecution evidence must be free from all material discrepancies, infirmities and inspiring the confidence of code. Court was of firm view that there were serious doubts as to involvement of the accused in the alleged occurrence and therefore prosecution failed to prove guilt against the accused beyond all reasonable doubts. The accused was therefore given benefit of doubt and was acquitted of the charges leveled against him, the judge ordered.
