AI report seeks repeal of PSA | `Pillai admits detention of minors’ | | Early Times Report Jammu, Mar 21: The Union Home Secetary, GK Pillai has admitted detention of minors under Public Safety Act (PSA) by the Jammu Kashmir government. This was stated by a three member team of the Amnesty international in summer capital today. The team released its report on PSA `A lawless law’ today. Pertinent to mention the Chief Minister has strongly contested detention of minors under PSA.
One of the members of the team, Bikramjeet Batra, who addressed the media said: “We met the Union Home Secretary Pillai on March 17 at New Delhi. During our meeting with him the issue of detention of minors came up for discussion. He admitted minors had been detained but blamed the state government for what he called serious lapse.”
The Amnesty member said that the state was governed by Juvenile Justice Act of 1997. “According to the Act a boy above 16 is not a minor. In rest of India the amended law (Juvenile Act of 2000 is applicable which says a person who has not completed 18 years of his age is a minor.” The AI urged the Legislative Assembly to do the needful in this regard.
Pillai also told the AI that the number of detentions under PSA would come down by 10-20% by the end of this year, claimed Bikramjeet.
The International watchdog on human rights has accused the state government of reckless and indiscriminate use of PSA. “Usually the police dossier and the order of detention passed by the District Magistrate are identical which reflects that the detaining authority rarely applies its mind”, the 82 page report reveals.
“The PSA has undermined the criminal judicial system. The police use this law to keep political activists behind the bars indefinitely. This must end”, the report said.
The AI has sought repeal of PSA. It also urged the government of India to allow members of International organizations especially the UN Rappoteur on torture to visit Kashmir.
The AI team was allowed to visit Kashmir last year in May after two decades. The team held around fifty meetings with human rights defenders, politicians, journalists and lawyers.
The separatists including Syed Ali Geelani, Malik Muhammad Yasin , Mirwaiz Umer Farooq and Shabir Shah have welcomed the report. However, the Chief Minister declined to comment.
