POTA court acquits alleged HuM ultra | | | EARLY TIMES REPORT JAMMU, Mar 22: POTA/TADA court special judge Pawan Dev Kotwal has acquitted alleged Harkat-ul-Mujahideen (HuM) militant Mazhar Hussain as police failed to establish charges against him. According to police case, an information was received by Mendhar police station on January 4, 2002, that Hussain along with other armed militants entered the house of Mohammad Aziz at Bathidhar on January 3, 2002, night and fired at him, causing him serious injuries. On the receipt of this information, a case was registered at Mendhar police station under sections 456, 121, 122, 307 and 120-B of RPC read with sections 7/25 and 26/27 of Arms Act and section 3(2) of POTA. Hussain was later arrested by police and during investigation, it became known that he had been working with HuM and had taken a pistol and cartridges from outfit's deputy area commander to indulge in militancy and spread terror. In his judgement, the judge observed that as police failed to prove their case against the accused, the challan was dismissed and accused was acquitted from the charges levelled against him.
