Regularization of adhoc, contractual employees expedited: Rather | | | EARLY TIMES REPORT Jammu, Mar 24 : The Finance Minister, Abdul Rahim Rather, Thursday, said the process of regularization of adhoc, contractual and consolidated employees working in different departments was being expedited to cover other departments left out due to late submission of cases to Empowered Committee. This was stated by the Minister while replying to a clubbed question by Mushtaq Ahmad Shah and Abdul Razak Zawoora in Legislative Assembly here today. The Minister said the Government has formulated a policy for regularization of Adhoc, Contractual and consolidated employees. He said in this regard Jammu and Kashmir Civil Services (Special Provisions) Act, 2010 has been enacted. He said prerequisites which are to be ensured as per Act for regularization are; appointment against clear vacancy and posts in a government department, that the employees continues to work as such without any break, that the employees possesses all requisite qualification and eligibility for the post on the date of his initial appointment on adhoc or contractual or consolidated basis as prescribed under the relevant recruitment rules governing the service of post and that no disciplinary or criminal proceedings are pending against the appointee. The Minister said the Empowered Committee constituted by virtue of the Jammu and Kashmir Civil Services (Special provisions) Act, 2010 has a mandate of scrutinizing the cases of contractual, Adhoc and Consolidated employees. He said so far, this Empowered Committee has held three meetings, out of 193 cases pertaining to 15 Departments only 18 cases were found eligible and 19 cases ineligible. He said in 156 cases of different departments, discrepancies and incompletion have been noticed as per provisions of the Act. He said these have been communicated to the respective departments. As and when the deficiencies in respect of such cases are removed by the departments and furnished to Finance Department these cases would also be enlisted for consideration by the Empowered Committee, he added. He said the number of cases of these 15 departments received, found eligible, ineligible and cases where deficiencies have been noticed were compiled. The Minister further said the Committee is in the process of scrutiny of cases and final decision about the same is being taken on the basis of the provisions of the Act, which provides that the upper age limit as prescribed under rules, for entry into Government Service shall be relaxed, in case the adhoc or contractual or consolidated appointee is otherwise eligible for regularization under this Act, provided such appointee has crossed the age limit at the time of his regularization but was within the prescribed age for appointment into the Government service at the time of his initial appointment as such or his age was relaxed by the competent Authority at the time of his initial appointment. The Minister said that the Adhoc or contractual or consolidated appointee shall be treated as an in- service candidate so for as the upper age limit is concerned for direct recruitment to Government Service, provided his adhoc or contractual or consolidated service is subsisting on the date of issue of the advertisement notification by the recruiting agency.
