| Court granted bail in MBBS Examination Scam | | | Jammu, July, 29 : Chief Judicial Magistrate Jammu Mr. Sanjay Dhar has granted bail to two accused namely Bharat Bhushan Gupta and Hoshnak Singh on medical ground and old age with the direction furnish bail bond and one surety in the amount of Rs 20,000/- each. While granting the bail CJM observed that accused Bharat Bhushan Gupta is suffering from some ailment and advised complete bed-rest as per the photocopy of prescription of doctor and also keeping in view the fact that accused Hoshnak Singh is of seventy years old, accused applicants are admitted to bail with the direction that they shall appear before the Investigating Agency as and when called.
According to the police story on July 22, 2006 while examination of candidates common entrance test was being held at GGM Science College Jammu, it was during verification that instead of two candidates Ashish Gupta bearing Roll No 200217 and Harshvardhan Singh Roll No 200390 two other persons namely Sandesh Kumar alias Angat of UP and Pawan Kumar alias Umesh Kumar of Patna had appeared in the examination by impersonation. These two impersonators were apprehended by the Supervisory staff and handed over to police along with the complaint for registration of case. An FIR 106/06 u/s 416/419/420/467/468/120-B RPC and section 5 of Prevention of unfair means examination Act and started investigation. During investigation it was found that fathers of the two candidates namely Bharat Bhushan Gupta and Hoshnak Singh in connivance with main accused Jatinder Singh Jamwal hired the services of two impersonators so as to bringing the prospects of their children in the examination, brightened in an illegal manner. Hoshnak Singh and Bharat Bhushan Gupta has been arrested, who filed the bail application on the ground that accused Bharat Bhushan Gupta and Hoshnak Singh as per the prosecution case have merely paid the money for procuring the services of some brilliant boys, who could sit in the examination on behalf of their children, cannot be stated to have been committed any offence u/s 467/468 RPC. After considering the facts of the case, Court granted bail to accused on medical ground and keeping in view of old age. JNF
