LPAs about transfer policy of ReT teachers quashed | | | EARLY TIMES REPORT JAMMU, Mar 26: A division of the high court today rejected as not valid 24 LPAs filed by education department and others against a single court judgement whereby a condition of the transfer policy of ReT teachers was quashed. Earlier, a deputy advocate general brought to the court notice that that the condition of the transfer policy stood deleted and in its place, a new condition had been incorporated vide February 15, 2011, government order. In the new condition, those recruited and regularised under ReT and SSA schemes, would be considered for transfer only after their promotion to the next grade. The court observed that newly incorporated condition was neither the subject matter of challenge in the 24 appeals nor was so in the writ petition as the new condition was inserted on February 15, 2011, while the earlier one, made the subject matter of dispute by the petitioner, was imposed on January 12, 2010. The new condition has been incorporated by deleting earlier condition. The court was of the considered view that the adjudication of issue involved in the basic petitions as well as the 24 appeals would only be of academic interest as such court would refrain from commenting upon it and dismissed all the 24 appeals having been rendered infructuous. DB, however, observed that if any person was aggrieved of new condition incorporated in the transfer policy of 2010 would be at liberty to challenge it in accordance with law.
