| HC direction on polythene | | | Srinagar, Nov 14 The Division bench of Jammu and Kashmir High Court comprising Chief Justice, Justice B.A. Khan and Justice Bashir Ahmad Kirmani in a case titled S.R. Institute v/s state of J&K has passed several directions to the concerned authorities to enforce ban, sale and use of polythene. The court has asked the concerned authorities to submit their plan of action and mechanism adopted by them for implementing the ban while directing the government to expedite process of legislation on the subject and also requiring the Municipal Authorities to take steps under the powers enjoyed by them. The Medical Superintendents of government hospitals and management of all private hospitals were also directed to submit their action plans on similar lines. The Directors of Health Services Kashmir and Jammu, Srinagar Municipal Corporation and Vice Chairman LAWDA have been directed to seek compliance report from management of private hospitals and direct them to appear before the court on the next day of hearing alongwith status report. Perusal to the status reports submitted by various authorities, the court observed that no concrete and specific action plan has either been adopted or indicated by them which could constitute permanent mechanism for enforcing the court order imposing the ban and ultimately of the legislation which was on anvil. The government has been directed to get the proposed legislation, imposing ban on use and sale of polythene, published inviting suggestions from experts. In case suggestions or recommendations are submitted, the same should be considered for finalizing it before the legislature for enactment. All concerned authorities are directed to submit fresh action taken report within one week.
