Amendments to make existing act broad based: Rather | Bill to amend Registration Act introduced | | EARLY TIMES REPORT JAMMU, Mar 28: Minister for Finance, A.R. Rather today introduced a Bill to amend the Registration Act, Samvat 1977 in the legislative Assembly today. Sating the objects of the bill, Rather said that amendments in some of the existing definition clauses of the registration act have been proposed so as to make them broad based and to include the provision for making use of the information storage devices like floppy, disc, hard disc, compact disc, etc within its scope. He said Section 7 of the Act has been amended to pave way for re-organization of the hierarchy for Registration Establishment. This amendment empow4ers the government to appoint Additional Inspector General of Registration, Joint Inspector General of Registration and Deputy Inspector General of Registration and prescribe duties for them and shall be instrumental in setting up a single authority for registration and stamps. Minister said that proposed amendment to insert section 16-A is aimed at making provision in the Act for keeping the prescribed books in electronic devices like floppies, disketes or in any other electronic form. Besides, a copy or extracts from such books shall be deemed to be a copy under the relevant provisions of the Stamps Act. He said that amendment in section 17 of the act has been proposed to make the document of contract of sale of immovable property compulsorily register able. With this amendment, any person presenting a document for registration will have to affix his photograph and also put his/ her thumb impression. For a document relating to the transfer of immovable property it will be obligatory on the part of both, the seller and the buyer to fulfill these requirements. Minister said that amendments in section 45,46, 51 and 54 have been proposed with the purpose of simplification of procedure. In place of copying of the documents in Book 1 Book 3 prescribed under the Act, true copy would serve the purpose. Likewise true copy would also hold good for purposes of sections 55, 60 and 61 as per the proposed amendments in these sections. Likewise the proposal amendments in section 69 would bring in the ambit of rule making power of Inspector General of Registration the manner and the subject to which safeguards the books may be kept in electronic devices, the regulating mechanism for presenting documents for registration and regulating the manner for recopying of books, or portions thereof, Rather added.
