| Court awarded 6 months, fine in cheque bounce case | | | EARLY TIMES REPORT
Jammu, March-30(JNF):- Special Mobile Magistrate Passanger Tax Jammu Mr. YP Kotwal, has awarded sentence of six months imprisonment and fine Rs 1,80, 000 to one Kasturi Lal s/o Krishan Lal c/o Baral Soap Industry Pouni Tehsil & District Reasi.
According to the complaint that accused having friendly relations with complainant Pankaj Kumar approached the complainant for financial assistance in the month of July 2003, upon the assurance of accused complainant advanced Rs 1, 75, 000 to the accused. In order to clear the said liability, accused issued cheque on September 23, 2004 for an amount of Rs 1, 75, 000/-. The complainant presented cheque through his banker the cheque was dishonored with remarks “payment stooped by the drawer”. Upon this complainant filed a complaint u/s 138 of Negotiable Instruments Act.
The Court after hearing the parties observed that it is absolutely clear that the complainant has proved the guilt against the accused punishable u/s 138 NI ACT beyond any reasonable doubt. Hence, the accused is convicted and sentence to undergo imprisonment for six months and fine of Rs 1, 80, 000 for the commission of offence and Court ordered that out of the fine amount, an amount of Rs 1, 75, 000 will be paid as compensation to the complainant and balance amount of Rs 5000/- in Govt treasury. The accused who was present in the Court was taken into custody forthwith to undergo imprisonment.
