CJM rejects bail of Chairman, Secy of Priyadarshni Institute

Jammu, April-01:- Chief Judicial Magistrate Jammu Mr. MS Parihar today rejected the bail application of Sunil Sahni Chairman and Anil Sahni Secretary (both real brothers) of Priyadarshni Institute & Management of Sciences who were arrested by the police on March 27, 2011 on a complaint in which it has been alleged that both accused along with one Joginder Sharma r/o Paloura Supt of said Institute have collected huge amount by way fees from the students illegally with intention to earn profit by fraudulent means for registration of the students with the Jammu University, but without registering the students with the university are conducting fake examination on the basis of fake question papers as such they cheated the students of the institution. On this report the Gharota police registered a case u/s 28 of 2011 U/Ss 420/467/468/34 RPC and started investigation. During the investigation police seized the fake question papers prepared by the accused and examination forms and attendance sheets have also been recovered and seized.
CJM after hearing CPO Pawan Khajuria assisted by PO Rajesh Basotra for the state and after perusal of the police report and the case dairy, it transpires that applicants are allegedly involved in the commission of offences U/Ss 420/467/468/34 RPC as the accused have prepared fake question papers and were conducting the fake examination of the students in the institute with criminal intention to commit fraud with the students and the alleged accused have spoiled the career of the students by conducting fake examination. The allegations against the alleged accused are of serious nature and offences allegedly committed by the applicants are non-bailable. In view of the allegations which are the serious nature, Court is of the view that the offences allegedly committee by the accused are heinous in nature as the main object of the applicants was to collect huge amount illegally and by fraudulent means for earning profit. The investigation in the case is at initial stage, as such the applicants do not deserve the concession of bail at this stage and dismissed the bail application. It is worthwhile to mention here that the third accused Joginder Sharma has not arrested so far. JNFJNF/APRIL/01/2011/2
