Taking cognizance of an application filed by one Kuldeep Gupta President Ward No 15 Jammu Central Mahajan Sabha Jammu seeking direction regarding the election of President Jammu Central Mahajan Sabha, the court stayed the election till next date of hearing. The petitioner seeks declaration of the election illegal and violative of the Sabha’s constitution. The learned magistrate observed that Court is satisfied that prima-facie the applicant has a strong case in his favour and more over the same appears to be urgent in nature that being in the immediate indulgence of the Court in the matter is found imperative, in view of that the issuance of prior notice to the non-applicants, the process of holding the election to the post of President Jammu Central Mahajan Sabha Jammu is stayed till next date of hearing. However, the order shall be subject to objection of the other side and Court also issued notice to All India Central Mahajan Sabha through its General Secretary/President, Jammu Central Mahajan Sabha, Election Commissioner JCMS and Romesh Gupta and fixed April 5, 2011 for appearance and objections to the applications.
