CBI books Ex-Maj Gen, 2 mill-owners in Jammu | Nexus caused loss of Rs 4.5 Cr to public exchequer | | Early Times Report Jammu/April 9 After submission of closure report twice, Central Bureau of Investigation (CBI) finally booked and challaned a former Major General and two owners of flour mills for allegedly being in nexus and causing loss worth 4.5 Cr to the state exchequer. The challans were produced on the order of Special Judge Anti-corruption, Mr AK Kaul. CBI registered a case against them under section 120-B,420,468 RPC and 5(2)r/w 5(1)(d) of J&K P.C Act on the ground that then Major General Army Supply Corps (AS) at Northern Command, D S Nehra, who was then at the helm of affairs, had conspired with the mill-owners to cause loss to the public exchequer. The officer has been charged with hatching a criminal conspiracy with the owners of M/S Kash Ind,Rollar Flour Mill Narwal Bala,Jammu and M/S New Jammu Flour Mill Sarore Adda,Jammu to confer wrongful gain on the latter through illegal deeds. Nehra, abusing his official position as public servant on the part of conspiracy adopted the highly exorbitant, unreasonable rates for grinding of wheat and supply of flour to army depots which caused a huge loss to the tune of Rs 4.5 Cr to the public exchequer.
The tender was floated by Headquarters Northern command for grinding wheat and supply of flour to troops of 14 Corps,15 Corps and 16 Cops during the year 2006-2007. After the due process of tenders received it was found that M/S Kash Ind.Roller Flour Mill, Jammu was the lowest tenderer for HQ 15 corpse and M/S Kissan Flour Mill for HQ 16 Corpse. M/S Kash.Ind. Roller Mills were within reasonable rates and were accordingly recommended for award of contract. While the process on the part of army was in progress M/S Kissan Flour Mill approached to the High Court with the plea not to allot tender to M/S Kash.Ind Mill thus Nehra opted for resorting local monthly purchase from June 2007 to Feburary 2008 which caused loss of Rs 1.20 Cr to the state exchequer. All this showed laxity on the part of then Major General Nehra. Later quotations for local purchase were opened by the board of officers under the supervision of Presiding officer. Here again Nehra accepted the tender of M/S Kash.Ind Mills and was assigned the contract of grinding wheat and supply for flour to 15 Corpse. Similarly New Jammu Flour Mills was allotted the work of grinding and supply of flour to 16 Corpse on lowest quotations but with the passage of time both the mills increased their rates in collusion with Nehra. Consequently, thus there was a loss of Rs 27,92,202 in 15 Corpse on account of grinding ,transportation of wheat from FCI to mill and transportation of Atta from mill to depot and corresponding gain to M/S Kash Ind.Roler Flour Mills Jammu. Similarly in 16 Corpse, there was a loss of Rs 27,39,509 on account of grinding, transportation of Atta from mill to depot and a corresponding gain to M/S New Jammu Flour Mill, Jammu. Thus total loss of Rs 55,31,711 was caused to 15 Corpse and 16 Corpse for one month and this process was continued for eight months as such the public exchequer suffered loss of Rs 4.5 Cr. Court observed that it was the duty of the Major General to keep check on increasing rates of the millers though they submitted lowest rates in their quotations. Nehra also submitted a plea that the rates were increased due to increase in electricity tariff , fuel and increase in freight, However, the same had fallen flat when CL Bhan Traffic Managar,Narwal in his statement said that there was no hike in freight and similarly Assistant Labour Commissioner Jugal Kishore also refused enhancement of wage, though there is mariginal increae in electricity tarrif .Keeping this in view court ordered CBI to arrest culprits and produce challan against them accordingly.
