Court rejects Anara's petition seeking Rs 2 cr damages

JAMMU, Apr 15: Principal district judge A K Shan today rejected Anara Gupta's petition for recovery of damages of Rs 2 cr from respondents.
The suit was filed by Anara against state and police personnel for arresting her and keeping her in illegal confinement for 11 days without any authority and further subjecting her to severe physical
as well as mental torture.
In the petition, she alleged that she was arrested in a false and frivolous case damaging her reputation among friends, relatives, colleagues, and general public by misusing and abusing police power.
After hearing both the sides, the judge noticed that as per Rule 3 of 33 CPC, it had to be presented by the petitioner in person. As per Rule 33 read with 5 of CPC, if the petitioner was not present in
person as per Rule 3, the petition had to be rejected and as such this petition was rejected.
