| CJM Kathua rejects bail of rape accused | | | Kathua, Nov 16 Chief Judicial Magistrate Kathua Varinder Singh Bhou has cancelled the bail application of an accused, who was booked by the police for allegedly kidnapping and rapping a minor girl. In its order the court rejected the bail application of the accused, Vikram Singh alias Goldy S/O Late Prem Nath R/O ward No 14 Kathua, following which the accused was sent to judicial custody. As per the Police report on 18-08-2006 one Karanjeet Singh S/O Kartar Singh R/O Rajbagh Kathua lodged a written report at Police station Kathua accused kidnapped his younger daughter, who had gone to the house of her sister. In consequence of this report FIR No. 235/2006 offence u/s 366/376 RPC was registered against the accused and investigation was started. The victim, as per the police, was recovered from the possession of the accused on 27-10-2006 and accused was also arrested. Chief Prosecuting officer Ravinder Rao appearing on behalf of the state argued that investigation is in progress and if accused is released on bail, he will hamper the investigation and jump over the bail and win over the prosecution witnesses. As the offence is heinous in nature, the prosecution sought the dismissal of the bail application. While rejected the bail application, the Chief Judicial Magistrate observed that prima-facie offence u/s 376/366 RPC against the accused person was made out and the grant of bail at this stage will have pre-judicial impact on the on-going investigation and further the case of society shall be defeated. |
