Dogra certificate challenged in Budgam court | | | Early Times Report srinagar, Apr 16: A resident of Chadoura area of Budgam district has challenged issuance of Dogra Certificate by the state Revenue Department in the court of Chief Judicial Magistrate (CJM) Budgam. CJM Budgam, Pervez Hussain Kachroo, admitted the petition and issued notice to the respondent Government of Jammu and Kashmir through Advocate General, Chief Secretary and Financial Commissioner Revenue. Asking for objections from the respondents, court has fixed April 30th as the next date of hearing. Sources said that CJM put the operation of order number Rev (LB) 69 of 2011 dated 25-03-2001 and Rev (LB) 52 of 2011 dated 7-4-2011 in abeyance till the objections are filed by the state. The order was issued after one Mohammad Altaf Bhat son of Ghulam Hassan of Porwara Chadoora in Budgam approached the court with the suit for declaration and injunction against issuance of Dogra Certificate. The applicant prayed before the court that the said government orders were aimed at creating a separate class of people within J&K and same could also disintegrate and divide the people of the state on ethnic lines. "That the issuance of Dogra Certificate, besides being in violation of provisions of constitution of J&K has drawn flak from legal experts and legislators and has effect of influencing Panchyat polls and has caused great prejudice to the interests of the public as well as the plaintiff," he prayed. The Judge after hearing arguments from both the counsel of plaintiff and public prosecutor put the orders in abeyance. "Heard the learned counsel for the parties and I've gone through the records on the file. Perusal of record at this stage makes prima facie and liss requires to be preserved," the judge observed. Minister for Revenue, Relief and Rehabilitation, Raman Bhalla, had on March 27 asked the people of Jammu division to avail the benefits of Dogra certificate after sanctioning its issuance. "The concerned Tehsildar (Territorial) shall be competent to issue such certificate to the eligible desirous persons irrespective of his or her ethnicity, religion, cultural background and mother tongue," said Bhalla. The move had come under criticism from separatist and Kashmir-based. |
