Is money taken by BJP MLAs for cross voting taxable?
4/17/2011 12:14:40 AM
Early Times Report
Jammu, Apr 16: Is money given to or taken by seven BJP MLAs for voting in favour of candidates fielded by the National Conference and the Congress in the just concluded Legislative Council election taxable ?By any yardstick the amount is taxable on two counts.
First,it is taxable because it has been earned by the MLAs irrespective of the fact whether it was earned after painful labour or it was a mere gift.Secondly, getting richer by several lakhs of rupees within a few hours cannot be treated as a gift from God.The money that the BJP MLAs have been given does not fall within the limit prescribed by the Income Tax Department for tax relief and that too when their monthly salary has been raised to Rs.80,000 and they are to get arrears to the tune of Rs.7.50 lakhs soon.
Hence it is for the Income Tax Department authorities to bring the seven BJP MLAs under their net and recover taxes that are due to be paid by them. But the Income Tax Department has one problem. How is it possible for its sleuths to find out whether each BJP MLA charged or was given Rs.six lakhs or Rs.50 lakhs.Reports keep on doing rounds in the state which say that about Rs.three crores have changed hands.
Another duty of the Income Tax Department is to find out the man or men,the agency or the agencies that paid each BJP MLA a hefty sum of money for cross voting.Once the Income Tax Department is able to find out the source from where the money was given to the BJP MLAs it is the job of the police and the intelligence agencies to find out whether the money that changed hands was white or black. They are supposed to find out whether the amount was part of the hawala transactions or belonged to some political party or to those rich businessmen who owe loyalty to the ruling NC and the Congress. Here again the Income Tax Department has to determine whether the money gifted to the BJP MLAs had been shown by the giver or the givers in their income tax returns.
There is no provision in the income tax rules that the money earned for changing one's ideas and ideology or for selling one's soul is not taxable.
It is not as important to find out whether Rs.50 lakhs or Rs.three crores changed hands as the source from where the money flowed into the pockets of the BJP MLAs.Since the rise of militancy the state of Jammu and Kashmir has become notorious for hawala transactions and a number of militants and their overground supporters have been arrested on charge of indulging hawala transactions.Hence it is imperative for the Central Government, the state Government cannot be impartial because it is a party to the crime,to hold a thorough probe.
Apart from the political fallout of the BJP MLAs' somersault its economic fallout cannot be ignored or sidelined.Once the source that bribed the BJP MLAs was identified it would expose many a skeletons in the cupboards of the National Conference and the Congress.
What is amazing is the response the BJP MLAs had shown towards recent fast unto death episode of Anna Hazare against corruption. The BJP leaders in Jammu supported Hazari's campaign for the Lok Pal bill. And these very BJP MLAs raped the spirit of the campaign against corruption.Possibly they wanted to go in for fast buck earning process before the Lok Pal Bill became a law.
Also it is necessary to find out if the money given to BJP MLAs had its roots in Pakistan where the agencies wanted to force the BJP to sell their ideology for a song.Since the BJP has been involved otherwise politicians would have been quick to discern involvement of foreign hand in the cross voting incident.Luckily nobody has raised a finger against the ISI for having been behind the episode in which money changed hands during the election to the "House of Lords."
