Computer Operators file contempt petition in HC
HC directed CS, Com / Secy Finance to file compliance report or appear in person

Justice YP Nargotra of J&K High Court Jammu wing in a contempt petition filed by Nisha Saraf and other Computer, Data Operators of State High Court Vs C. Phongsong Chief Secretary and Others, directed that compliance report shall be filed within a period of four weeks failing which the Commissioner/ Secretary Finance Department as well as the Chief Secretary shall appear in person for explaining their position. This direction has been passed when Additional Advocate General Mr. SC Gupta sought further four weeks time for filing the compliance report. Court allowed the prayer made by AAG and issued the directions.
Mr. AH Kochak Law Secretary present in the Court as per the direction of the Court filed statement of facts indicating that a request has been made to the Finance Department for according concurrence to wards the creation of selection grade posts in terms of judgment passed by High Court and upheld by the Division Bench as well the Supreme Court of India.
The petitioners who are working in the state High Court has filed Contempt petition seeking contempt proceedings against the erring respondent for willful disobedience and non implementation of the order passed by single Bench of the High Court on January 27, 2000 and upheld by the Division Bench on June 11, 2002. The state Government filed SLP before the Supreme Court of India, which passed order and modified the order of the High Court to the extent that the revision of pay scale was to be granted from the date of pre-announcement. The partial compliance to the order passed by the court vide Government order dated February 14, 2003 sanction was accorded to up gradation of 14 posts of Data Entry Operators working in the J&K High Court. It is further submitted that second part of the judgment is still unimplemented whereby the 25 % posts of available 14 posts were required to be upgraded on selection from amongst the employees who have put in five years services.
