CJM orders reinvestigation of decade old contractor's murder | | | JAMMU, Apr 25: Chief judicial magistrate (CJM) M S Parihar has ordered reinvestigation in the murder of a contractor in Jhajjar Kotli area over a decade back in which BJP MLA Jugal Kishore Sharma was a suspect. Contractor Raj Singh's body was recovered from the area on March 30, 1999. After Raj's father filed an application in the court, the CJM directed police investigating officer (IO) to complete investigation in the case within a reasonable time and take such action as might be required by the result of reinvestigation. According to the case, the IO recorded statements of 69 witnesses but no concrete clue as regards the real culprits was found. However, during police investigation, Jugal Kishore (sitting BJP MLA) and his brothers -- Nand Kishore and Ganesh Kumar alias Munna -- emerged as suspects in the case. Though police did not question Jugal, his brothers were questioned but no break through was achieved by police.The case was later closed as untraced. Though police filed the closure report, the court refused to accept it and directed reinvestigation of the case. After more than 10 years of investigation, police filed status report in the court on February 7, 2011. Earlier, the court observed that Raj and Jugal Kishore were interested in construction contract of railway bridges. The court also observed that one Julekhan, wife of Maskeen Ali of Kishanpur, had stated on June 4, 2001, that she was offered Rs 50,000 by one Sansar Chand of Kishanpur, Parkash Singh and Sham Lal of Khorkhoo with the condition that she must state before police that Raj had jumped from the bridge. Her statement was corroborated by Juman, son of Bikka of Jhajjar Kotli which meant that both these persons were to be eyewitnesses. It appeared that they had not been examined professionally, the court observed.The CJM took serious note of the investigating agency, saying the deceased's father was approaching different authorities, including courts, for seeking justice in the case by apprehending the culprits involved in the case. The investigating agency, under law, had to complete investigation of a case within a reasonable time under CrPC and it was statutory duty of police to investigate the crime and book the culprits but in the instant case, which took place in 1999, the investigating agency had not been able to complete investigation till date.With these observations, the court directed the investigating agency to complete investigation within reasonable time.
