Court grants bail to former SDM, ors
Fake gun license scam

Jammu, April-26:- Special Judge Anticorruption Jammu AK Koul today granted bail to Mukhityar Ahmed then Sub Divisional Magistrate Mendhar, Ranjit Singh of Rajouri and Qasim Hussain who are involved in issuance of fake gun license scam.
CPO Pawan Khajuria opposed the bail applications on various grounds including that as on now 74 fake licenses have been recovered although the evidence collected shows that 695 such licenses are in circulation.
Special Judge Anticorruption Jammu Mr. AK Koul after hearing Sr. Adv Sunil Sethi for then SDM, Adv Mohd Arif Qasim Hussain and Adv Ashok Sharma for Ranjit Singh observed that the CD file reveals that about 70/75 witnesses have already been examined. A lot of documentary evidence has been collected by the IO but the investigating agency believes that there is some record yet to be recovered and the petitioners do not cooperate in tracing that record. Upon this Court said that this can be a ground for refusal of bail as the petitioners are in police custody for almost 10 to 15 days and if the record could not be recovered during this period, how would further detention of the petitioner help the Investigating Agency. The principal offender then SDM Mukhtiyar Ahmed his chances of fleeing justice or minimum and so is petitioner Qasim Hussain an official of the Govt, Court cannot at this stage believe that if the concession of bail is extended to these officials and also to Ranjeet Singh accused, they would misuse the concession in any manner. With these observations Court allowed the bail applications filed by the alleged accused and directed the authority to release from custody provided they furnish personal bond of Rs 50,000 each and one surety each in the like amount with other directions including that petitioner would attend the IO every day for two hours to facilitate completion of investigation for a period of one week and thereafter as and when required by Investigating Agency.
