Court acquits Sewa Hydel Project AAO in corruption case | | | Early time report JAMMU, Apr 28: Special judge anti-corruption, A K Koul today acquitted Ravinder Singh Samyal, assistant accounts officer (AAO), Sewa Hydel Project, Basohli camp Office, who was caught red handed by state vigilance organization on March 25, 2004, while allegedly accepting Rs 5,000 as bribe from a Junior Engineer for settling his accounts.The judge said the evidence relied upon by the prosecution was shaky and did not connect the accused with the crime.Acquitting the AAO, Koul observed that statement of chief accounts officer, Sewa Hydel Project, Basholi, where complainant Arun Choudhary worked as JE and the statements of other officials wherein it was submitted that JE paid Rs 4,120 as income tax which was shown in the record but this amount was paid by project's financial advisor.So if the tax was paid by the department, the complainant was obliged to deposit the amount in the office. The AAO contended that since this amount was outstanding against the complainant, he had received it from him but he was trapped immediately. The court observed that mere acceptance of money by the accused would not show that he had accepted bribe unless it was shown that he knowingly accepted it as bribe.With these observations, the court acquitted the AAO of the charges levelled against him and prosecution case as such failed and dismissed.
