| Early Times Report JAMMU, Apr 30: A state accountability commission (SAC) probe has established that SFC high-ranking officials had in 2002 fraudulently issued a no-objection certificate (NoC) to Abdul Majid Wani, which made him eligible to contest assembly polls from Doda assembly segment, when a whopping Rs 177 lakh liability had been found against him by district and sessions judge Dev Raj Sharma as an arbitrator in the case.The SAC inquiry was conducted by deputy inspector general (DIG) of police, Gulzar Singh Salathia. "During the course of inquiry, it was established that Roop Lal Bharti, who was MD SFC in 2002, FA and CAO Janak Singh and deputy financial advisor (DFA) Sant Ram, with the connivance of SFC contractor Abdul Majid Wani, accorded approval/concurrence for a false document of NoC in his favour and got it signed by GM (adm) Asgar Anayatullah. By doing so, they are not only involved in the preparation of a false NoC but cheated the state government and election commission too as a huge liability of Rs 177 lakh had already been established against Wani by the district and sessions judge," the report says.Bharti was also alleged to have kept the file with him with malafide intention from September 19, 2002, to August 18, 2004, even after his transfer from SFC, the report adds. Wani needed NoC for his eligibility to file nomination papers as a candidate from Doda assembly segment in 2002. Without it, he could not have been permitted by the Doda returning officer to contest polls. Keeping its necessity in view, he filed an application on August 30, 2002, before Bharti, who marked it to GM Asgar.Asgar, in turn, marked it to the DFA, who was the real authority on the subject as he dealt with the SFC accounts of Jammu region. The DFA wrote on the file: "So far, the incumbent has neither remained defaulter nor bad debtor. It is further to intimate that at present there is nothing outstanding against him as per the record of the division. Hence for further necessary action."The report alleged that the DFA, who had allegedly joined hands with Wani, deliberately concealed the facts and forwarded a false report to his senior, cheating the authorities concerned and illegally aiding and abetting the issuance of a fake NoC to Wani." The file, with the alleged false noting, was sent by the DFA to Asgar on September 2, 2002, who then wrote to Bharti: "Since the DFA's recommendation is explicit, the MD may consider the issuance of NoC to Wani." The MD then sent the file to FA and CAO Janak Singh for his comments.Without applying his mind, Janak appended his signature to the file, giving his concurrence to the DFA's noting because no adverse remark was given by him, the report said. The false NoC was ultimately issued to Wani, who then produced it before returning officer, Doda, while filing his nomination papers as a candidate for assembly polls from Doda assembly constituency.The report said after the needful was done and Wani was declared eligible to contest elections, SFC officials started the process of withdrawal of the NoC. In the file, the FA later recorded that the real facts in the matter had not come to the notice of regional office and NoC was issued to Wani when there was huge liability of Rs 177 lakh against him. Though he sought the withdrawal of NoC, nothing was conveyed to the returning officer, or the election commission in this regard. The report said the FA's move was totally misleading as he had earlier appended his signature to the file without any adverse remarks. "In fact, FA, DFA and MD were fully involved in the issuance of fake NoC," the report alleged.The report said MD could not deny his alleged involvement in the matter as he too had appended his signature to the file without making any adverse remark. The report found that though the real conspiracy was hatched by theDFA and others in connivance with Wani, Asgar, who simply acted as a clerk to MD, was made the scapegoat and placed under suspension.Quoting the seized record, the report said an amount of Rs 23 lakh due to Wani against execution of works in compartment No 15-Keshwan was made to him under the approval of FA and CAO vide his letter No SFC/Acctt/4-6/C-SH dated July 15, 1991, as a special case keeping in view eid festival and labour problems. The probe also found out that SFC DM, east division, Kishtwar, A R Fazli had on October 1, 1991, advanced Rs 1.5 lakh to Wani without the approval of any legal authority.It was also found out that rates were unauthorisedly enhanced for "pathroo" activity from Rs 1.80 to Rs 2.10 and Rs 2.25 to benefit the contractor-turned-politician. The probe also established that SFC officers -- S I H Kazmi, O S Manhas, R M Saxena, Sheikh Mushtaq Ahmad and Ashok Kumar Sharma -- had allegedly processed, calculated and made excessive payments to the tune of Rs 3,93,599, Rs 2,62,399 and Rs 5,46,798 for pathroo activity to M/s Wani Concern Contractors.Official sources said as the central and the state governments had been apprised of the SAC findings, an appropriate action was awaited from their side.
