HC stays trial court order about chopper service to Bhavan | | | Early Times Report
JAMMU, May 1: On Global Vectra Helicorp's application, seeking permission to file appeal against the April 9, 2011, order of the Reasi district judge, Justice J P Singh of high court today issued notice and and directed to list the petition for hearing in the first week of June, 2011. In the meanwhile, till next date, the operation of Reasi district judge's order passed in a civil suit titled Sumit Aviation Pvt Ltd v/s chief executive officer, SMVDSB, Katra, and others was directed to stay. Staying the operation of trial court order, Justice Singh observed that perusal of the complaint filed by Sumit Aviation Pvt Ltd indicated that the relief sought was to declare the selection of Pawan Hans and Global Vectra for the providing helicopter services for SMVDSB as null and void, in-operative and in-effective which had been done arbitrarily and without adopting the CVC guidelines adopted for the tendering process. In this view of the matter, M/S Global Vectra Helicrops Ltd appeared to be a necessary party to the proceedings before the trial court. The cause projected by Sumit Aviation may not be appropriately adjudicated upon in its absence. Considered that the applicant had succeeded in making out a case for the grant of permission to file appeal against the order of trial court which was allowed and stayed the operation of order of trial court.
