HC directs state to grant monetary benefits to CAO | | | EARLY TIMES REPORT JAMMU, May 06: High court judge, Justice Mansoor Ahmad Mir today directed the state to grant promotional and monetary benefits to agriculture joint director Madan Lal Gupta. The court directive came in a writ petition filed by Madan Lal Gupta, who had sought direction to the respondents to release grade benefits in his favour with effect from July 1, 1995, and March 1, 1998. Justice Mir observed that after the petition was filed on April 27, 2006, notice was issued to the state, but it failed to file reply at pre-admission stage. Thereafter the petition was admitted vide order dated February 16, 2010. While deputy advocate general was asked to file "counter", he failed to do so. Ultimately this case was heard on July 29, 2010, and reluctantly four weeks time was again granted to the respondents for filing "counter" in order to come to the right conclusion. Despite all this, the respondent chose to remain in deep slumber. He observed that in the given circumstances, averments in the petition had remained unrebutted as a result of which the petition was allowed and respondent was directed to consider the case of the petitioner for grant of promotional benefits, i.e. monetary benefits, including pensionary benefits right from July 1, 1995, as CAO and from March 1, 1998, as joint director and make a decision within two months from the date this order was served upon the respondents.
