Court frames charges against negligent medico | | | EARLY TIMES REPORT JAMMU, May 11: Chief judicial magistrate (CJM), Jammu, M S Parihar
today framed charges against Dr Raj Rishi in a case of wrongful
death caused due to his alleged negligence. The charges were framed under section 304-A of RPC. The court fixed
July 7, 2011, for evidence. According to the case, on May 14, 2008, Kapil Gupta, son of Vijay
Gupta of Rehari Colony lodged a written report with the Bakshi
Nagar police station against Dr Rishi and the concerned staff of
Sarwal government hospital, stating that his brother Rajesh Gupta,
who had a stone in gall-bladder, underwent an operation in the
hospital through laparoscopy on May 12, 2008 at 9 am. The operation was carried out by Dr Rishi and his staff, but due to negligence and mishandling of
the case, the patient bled excessively and was referred to GMC
hospital after a lapse of pretty long time when his health
deteriorated due to excessive bleeding. On May 14, 2008, morning,
the patient died in GMC hospital. It was alleged that the concerned doctor was not trained to operate
laproscopically and this established negligence on the part of
doctor, his staff and the administrative head of Sarwal hospital. Acting on the complaint, police registered a case under section
304-A of RPC and after completion of investigation, presented
challan in the court. The CJM observed that keeping in view the principles of law laid
down by Supreme Court, the court was of the opinion that there was
sufficient material on the file to presume that the accused had
committed offence under 304-A of RPC. The court framed charges against him under 304-A of RPC and
directed CPO to produce the evidence on the next date of hearing,
ie July 7, 2011.
