| Alleged narco smuggler gets bail | | | EARLY TIMES REPORT
JAMMU, May 11: High court judge, Justice Mohammad Yaqoob Mir today
granted bail to Mushtaq Ahmed Malik who was facing trial in the
court of 3rd additional sessions judge, Jammu, under NDPS Act.
The court also directed that the petitioner must furnish bail bond
of Rs 50,000 to the satisfaction of the trial court and personal
bond of the like amount to the satisfaction of superintendent jail
concerned.
According to the case, 1.8 kg charas was recovered from the accused
and co-accused Feroz Ahmad Shah in the presence of a gazetted
officer on March 17, 2010.
Granting bail, Justice Mir observed that for the recovery of small
quantity of contraband, the punishment prescribed under section 20
of NDPS Act was up to six months RI and same was the position with
sections 21, 23 and 28 of NDPS Act.
The accused was arrested on March 7, 2010, which meant that he had
been in custody in connection with the offence for more than one
year, the judge said and granted him bail.
