HC comes to rescue of govt employee whose son is suffering from lifetime disease | | | EARLY TIMES REPORT JAMMU, May 14: In a petition filed by Ashok Kumar Koul, a government employee whose son is suffering from Hypopituiprisn and Seizures which required prolonged treatment, high court judge, Justice Sunil Hali observed that it was not in dispute that the petitioner was entitled to benefit of Rule 5 (5) provided he satisfied the requirement of provision of J&K civil service (medical attendance-cum-allowance) rules 1990. He submitted in his petition that medical claims of Rs 13,91,626 were processed and payment was made from time to time till June 2003. Thereafter the respondents did not reimburse the medical bills. Justice Hali said the issue raised as to whether the disease was life-consuming or not, was a matter to be determined by a medical expert and referred that there was already a certificate issued by HOD of Endocrinology department, AIIMS, who had indicated that the disease was life consuming and directed the respondents to obtain opinion of any medical expert or any person authorized under rules within a period of three weeks from the date of copy of this order was served upon the respondents. In case opinion of the expert affirmed the petitioner's contention raised,respondents would reimburse the expenditure incurred by the petitioner within a period of three weeks thereafter along with pending bills.
