Suspended BJP MLAs reject Disciplinary panel's call for May 20 meeting | Party's legal experts exploring options under J&K constitution reiterate Prof Gupta is leader of LP | | 'Committee has failed to produce documentary evidence' Early Times Report Jammu, May 18: In what appears to be suspended BJP legislators now heading for 'show down' against the high command, they have out rightly refused to 'accept' Jugal Kishore as the leader of the party in the Assembly, a decision which was taken by the leadership immediately after cross voting episode in which Prof Chaman Lal Gupta was 'identified' as having voted against the party candidate. The six legislators in the suspended camp have vehemently reiterated that Prof Gupta is their leader and also unequivocally rejected the 'call' of the Disciplinary Committee to attend the May 20 meeting at New Delhi. In a joint statement Jagdish Raj Sapolia, Master Lal Chand, Durga Dass, Prof Gharu Ram, Bharat Bhushan and Baldev Raj Sharma today reiterated that Prof Chaman Lal Gupta is the leader of legislature party, contending,"we repose our full faith and confidence in Prof Gupta ....... As per the mandate of our constitution, he continues to hold the office of Legislature Party in J&K Legislative Assembly". Sources said this jolt has come at a time when the panel of legal experts in the BJP are actively pursuing legal options to settle the matter at the earliest in party's favour, particularly in the wake of the open defiance and revolt mode which the suspended MLAs have been in for quite some time. Sources said the legal experts particularly the senior lawyers have requisitioned from the local leadership and experts at the state level the clarity of certain constitutional provisions of the state, since J&K is bound to follow every step according to the provisions of the constitution. Sources said the BJP experts are now studying and assessing the constitutional implications of the moves with regard to both expulsion as well as disqualification of the members in the House. On the other hand, the six MLAs have once again raised their pitch referring to legal and factual matters which are being detailed about cross voting, effect of cross voting as also the declaration of choosing another legislature party leader by three MLAs out of eleven who have been given clean chit . "We contradict the facts with full force at our command.......", the six MLAs asserted in the joint statement. The statement further says since the subject matter is subjudice before court they (MLAs) do not consider it proper at this stage to bring forth the true facts and law on the matter. taking a dig at the high command once again on parameter point, they have regretted that the Disciplinary Action Panel has so far failed to produce any documentary evidence which they (MLAs) had sought in their written replies to prove their involvement "It suffices to emphasis by us that we have submitted our reply to the show cause notices and demanded from the Disciplinary Committee the documentary evidence and also the names of those who have witnessed us cross voting and also the parameters applied for searching out us only leaving the other four for having cross voted....... Such documentary evidence so far has not been made available to us", they said. Making this as ground, the MLAs have clearly rejected the offer of attending the meeting on May 20 contending ,"since documentary evidence relied upon against us and based upon for issuance of show cause notices is not made so far available to us, therefore in the absence of said evidence we are unable to attend the disciplinary committee at Delhi on May 20....as such we are not appearing before the disciplinary committee in the absence of the documents.", the statement said on an optimistic note stating further, “we hope that the same shall be sent to us at the earliest enabling us to defend ourselves".
