Jugal issues MLA disqualification notices to 7 as 'acting leader' | Prof Gupta scoffs at move, says meaningless as he continues to be leader - 'Mischievous move amounts to superceding DAC' | | Early Times Report Jammu, May 23: In a sudden move which is bound to some ripples in terms of reaction, Jugal Kishore in capacity of the Acting Leader of BJP legislator Party today issued notice for disqualification from the post of MLA to the seven legislators of the party who already stand suspended from primary membership of the party. Prof Chaman Lal Gupta, scoffed at the move terming it as 'meaningless and mischievious activity' indulged in by the four legislators. He reiterated that he continues to be leader of the Legislative party and is waiting for the outcome of the central Disciplinary Action Committee in the proceedings in cross voting matter. BJP Chief Spokesperson and National Executive Member Dr. Jitendra Singh justified the action constitutionally said that as per para 2(1) (b) of the 7th Schedule of J&K Constitution, the BJP chief whip in the Assembly Ashok Khajuria filed a petition for disqualification of legislators to the acting leader of House Jugal Kishore Sharma who under the J&K Constitution, in his capacity as leader of BJP Legislators Party, holds the authority to disqualify the MLAs for violation of party whip. On the other hand Prof Gupta ridiculed at this move contending this was nothing but a 'mischief' by those who he said are 'culprits' to cover up their deeds. "I continue to be leader until no confidence motion is moved against me.....I enjoy the confidence of majority of the members which counts legally and constitutionally........the disqualification notice is means nothing in the backdrop of this reality", he asserted. I can see it only as a move aimed at their political survival, the veteran politician said. Significantly, he also said the step of issuing disqualification notice amounts to superceding the Central leadership as Disciplinary Action Committee is still moving ahead with its proceedings and has yet to announce its decision to the high command. Referring at the disqualification notice Prof Gupta contended that as leader of the legislators he had written a letter to all 10 MLAs seeking their views on the matter of cross voting. " I have yet to get their response........it is ironical and whatever they (four MLAs) are doing is surely not in the interests of the party." Such steps would prove to be damaging for the party as a whole at a time when we all should be united, he maintained on a 'cautioning' note. The question at this moment is that can they take such steps legally or constitutionally while keeping in view all facts, he added. The 7 MLAs against whom the notice of disqualification has been issued include Prof. Chaman Lal Gupta, Bharat Bhushan, Prof. Gharu Ram Bhagat, Baldev Sharma, Master Lal Chand, Jagdish Raj Sapolia and Durga Dass. The objections, if any, to notice can be filed within one week. On the other hand while disclosing about disqualification move, Dr. Jitendra Singh further said that in his communication as Chief Whip, Ashok Khajuria had written to the acting leader of the Legislators Group that he had issued a whip to all the members of BJP asking them to vote in favour of the party candidate Thakur Ranjit Singh. Khajuria further states in the communication that from the result of the election, it is clear that the seven (7) MLAs of BJP mentioned above did not follow party whip issued by him and indulged in cross voting. After narrating in writing the entire sequence of facts and circumstances related to the issue, Khajuria moved a petition before the acting leader that all the seven MLAs had incurred disqualification under para 2 (b) of 7th Schedule of J&K Constitution and may therefore be declared disqualified from being the members of Vidhan Sabha. Dr. Jitendra Singh mentioned that every aspect related to the issue of cross voting is being dealt by the party High Command depending on the inputs received by it and in keeping with the constitutional procedures. |
