Anticorruption Court grants interim bail to TSO Kishtwar

Jammu, May-24 (JNF):- Special Judge Anticorruption JammuAK Koul today granted interim bail to Sujjan Singh Chauhan then TSO Kishtwar for a period one week provided he furnishes a personal bond in the amount of Rs 50,000 and a surety in the like amount with the direction that he would remain cooperating with investigating agency by associating himself with IO for three days in a week between 10:00 AM to 1:00 PM or as and when required without fail.
According to the case VOJ registered FIR NO 6/2011 u/s 5(1) (e) r/w 5(2) PC Act and raided the three premises of TSO by the VOJ.
Today the petitioner surrender in Court and has been taken in judicial custody in the open court in the bail application filed through Adv Sudershan Sharma in which it has been urged that petitioner is Govt employee and at the verge of retirement but he has been falsely implicated and registration of the case has put him and his family in constant harassment and seeking bail. In the objection filed by CPO in which it has been submitted that the investigation of the case registered against the petitioner is going on and during the investigation, the houses occupied by the petitioner at different places and incriminating the documents have been found and seized and the matter requires further investigation to ascertain the extent of involvement of the petitioner. CPO further submitted that the case has been registered against the petitioner on May 11, 2011 and since the investigation is still in-infancy and so the concession of bail cannot be extended to petitioner.
Court while considering the arguments of both the sides and also gone through the report and objections filed by VOJ observed that the Court is of the opinion that the prayer of counsel for the petitioner for grant of interim bail is workable and the purpose of justice would be served appropriately if the prayer is allowed and an interim bail for a period of one week from today is granted.
