| Man convicted for sodomy | | | Kathua, Nov 21 Chief Judicial Magistrate Kathua Varinder Singh Bahu has convicted one Rajesh Kumar of Nagri Parol for indulging in sodomy at with a minor child and sentenced him to undergo rigorous imprisonment for three years and fine of rupees five hundred. As per the sources, after haring both the sides and going through the evidence on record the court observed that the offence is proved to have been committed by the accused beyond any shadow of doubt. The court further observed that the accused has committed heinous and unnatural crime and it was done voluntarily by the accused, sources told News Agency of Kashmir. The evidence on the record, held the court, even prove the penetration of penis in the anus of the victim. “The offence of sodomy punishable under section 377 RPC is heinous in nature and the law does not permit any leniency in favour of the accused”, the court observed adding, “further the manner in which the offence was committed send shivers down the spines and reflect the barbaric and beastly instincts of the accused”. As per the prosecution story one Nayayan Shamra of Nagri Parrole, Kathua had lodged a report with the concerned police station that his eight year old son, who was playing in the street, was taken away by Rakesh Sharma in his house on October 11, 1997. The child, on his return, had told his parents that he was sodomised by the accused. |
