Court denies bail to rapist | | | EARLY TIMES REPORT Jammu, May-25 (JNF):- Judicial Magistrate RS Pura Manjeet Rai today dismissed bail of Govind Kumar alias Naiyamat Kumar who was arrested by the police in a case of abduction and rape with the minor girl. According to objection filed by Senior PO Anil Dev Jamwal seeking rejection of bail on various including that during the intervening night of April 20/21, 2011 at about 2:30 AM, the prosecutrix came out of her room to urinate, in the meanwhile the accused Govind Kumar and gag the mouth of prosecutrix and forcibly took her near by shop and kept her in illegal confinement and raped her. The accused freed the prosecution at about 6:00 AM in the morning and threatened her of life if she would tell about the incident to any body. A case u/s 363/376/342 RPC was registered at P/S RS Pura and further said that investigation of case is at pre-mature stage and custody of the accused is required for proper investigation of the case. While dismissing the bail Judicial Magistrate RS Pura Manjeet Rai after hearing both the sides observed that the accused is alleged to have committed the offences u/s 363/376/342, the offences 363 and 376 RPC are non-bailable and serious in nature as such the accused cannot claim bail as matter of right. No doubt liberty of citizen must be protected by the Court, however, when a person is accused of offence like 376 RPC (rape), Court has to keep in mind the interest of the prosecution, near and dear of the victim as well as the interest of the society. With these observations Court dismissed the bail application of accused. JNF
