NHRC directs state govt to arrest BJP MLA | Raj Singh murder case | | Early Times Report JAMMU, May 25: Already grappling with the cross voting issue and heading for an imminent split, the State Bharatiya Janta Party (BJP) is facing yet another trouble as the National Human Rights Commission's (NHRC) directive to arrest its acting Legislature Party leader and MLA Nagrota Jugal Kishore in an eleven year old murder case viz a viz handing over the probe to Central Bureau of Investigation (CBI). The NHRC's direction came after the deceased Raj Singh's father Dina Nath approached the Commission with a plea that the BJP legislator is trying to influence the case by intimidating the witnesses as well as the family members of the deceased. The Commission has also recommended to the State Government to register cases against the then Station Houser Officer (SHO) Jhajjar Kotli, Investigation Officer (IO) and Additional Superintendent of Police (ASP) Rural Jammu for violation of human rights' of the complainants in the said case. It is pertinent to mention here that on March 30, 1999 Manwal Police post received information that an unidentified body is lying near Tawi bridge. After thorough enquiry, the identity of the deceased was established as 22-year-old Raj Singh of Kathar Manwal, block Dansal in district Jammu. In this context, the police registered a case against FIR No. 44/1999 under Section 302 in Jhajjar Kotli police station and the investigation into the case was launched. Meanwhile, relatives of the deceased Raj Singh accused BJP leader Jugal Kishore for the killing of the former. However, the Police closed the case on March 28, 2006 saying that there is no evidence against the persons charged for the murder. Disheartened and disappointed by the state police's probe into the killing of his son, Dina Nath, an ex-serviceman, approached the NHRC in a hope to get justice. Dina Nath in his petition said that he and his family are under constant threat from the BJP leader, who in the meantime had become MLA in 2002. He further said that it was due to the manipulations of the BJP leader that the police hushed up the matter. Taking cognizance of this case, the NHRC sought the police investigation diary and the January 8, 2007 ruling of the then Special Municipal Magistrate Sanjay Parihar January 2007. The Commission after conducting a inquiry found that the BJP leader created hurdles after hurdles in the first four years of the investigation even thought the Special Municipal Magistrate in his order said that the case should be investigated again and all the accused named in the murder be arrested and put to sustained interrogation however no action was taken by the police on Court ruling. The NHRC while completing the investigation in clear terms asked the State Government to initiate action against SHO Jhajjar Kotli, IO and ASP Rural Jammu. At the same time, the NHRC directed the State to arrest all those named in the FIR registered at Jhajjar Kotli police station. The accused who have been named in the FIR include BJP MLA Jugal Kishore and his brothers Nand Kishore and Ganesh Kumar alias Munna son of Bal Kishan, all residents of Kishanpur, Tehsil and district Jammu. The NHRC also directed to hand over the investigation to CBI and ensuring safety of the complainant and his family members. |
