'Majority vs minority' group fight reaches Speaker, MLAs led by Chaman call on Lone | vSpeaker has assured us he will go by majority decision, claims 'leader' vGroup of 4 would invite action if they continued with anti leader behaviour: Prof Gupta | | Early Times Report Jammu, May 25: In what it assumes the shape of majority vs minority fight, the BJP legislative Party group led by Prof Chaman Lal Gupta today called on the Speaker of the Assembly Mohammad Akbar Lone here today and discussed constitutional provisions which gurantee 'powers' the leader enjoying majority support. The group claimed Speaker's assurance that he would go by what majority group and their leader decide in the wake of disqualification move initiated by the 'Acting leader' Jugal Kishore Sharma. "We met Speaker and discussed a host of issues related to cross voting episode and the developments thereafter.........he (Speaker) is well aware of the constitutional provisions and assured he would always uphold the constitution and majority decision shall prevail....", said Prof Gupta while explaining the details of the which lasted for over one hour. In the light of the constitutional provision the Speaker admitted and agreed that disqualification notices issued by the 'Acting leader' has no value or meaning, the veteran politician Prof Gupta maintained. Only one MLA Lal Chand from Bani could not attend the meeting because of bad healt. Five others led by Prof Gupta included Jagdish Raj Sapolia, Prof Gharu Ram, Durga Dass, Bharat Bhushan, and . Baldev Raj Sharma. During the meeting the M.L.As observed that a 'small group of Legislators' belonging to BJP has been indulging in disinformation campaign to mislead the media as well as public about the leader of BJP Legislature Party."A villification campaign has been launched against us by alleging that we have indulged in violation of party whip..... there have been murmurs that action will be taken against us for disqualification on thegrounds of defection", the MLAs conveyed to Speaker. Confidant on a strong constitutional footing, the group also drew the attention to clause "6" of seventh schedule which read :" If any question arises as to whether a member of the House has become subject to disqualification under this schedule, the question shall be reffered for the decision of the Leader of the Legislature Party to which such member belongs and his decision shall be final". The group also claims that Speaker having acknowledged the fact that Prof Gupta has been elected of the BJP Legislative Party unanimously by 11 members and that he continues to be so until any no confidence move is initiated against him. "In view of the constitutional position as and when a question arises as to whether any member of the House should or should not be disqualified , the same has to be decided by Prof.Chaman Lal Gupta. He alone can either initiate action against any legislator or to issue any show cause notice .........", the group contends as having been maintained by the Speaker as well during the meeting. "It looks ironical that disqualification notice has been issued againat me as well...... minority group is indulging in villification campaign have either not read the constitution or are deliberately trying to mislead the public.....We are observing great restraint to avoid any unpleasant situation, but the minority group in our party is doing every possible thing to damage the Party", he said. "IF they continued to behave in same manner I would be constrained to take action against them", Prof Gupta asserted. Now even as the group today met the Speaker in a formal manner, sources said the Lone has conveyed to the group that even as constitutional provisions favoured them, the bickerings which were getting 'dirty' by the day between the two factions needed to be put at rest. Speaker is also said to have received the communication from Jugal Kishore in capacity of the acting leader, something which carries no weight in the wake of explicit constitutional provisions. |
