HC sets aside JKPCC helper's suspension order after 36 years | | | EARLY TIMES REPORT JAMMU, May 26: After 36 years of his suspension from service, high court today termed the suspension order of a JKPCC helper as fully unjustified and contrary to rules. JKPCC helper Bal Krishan Raina was placed under suspension on July 10, 1975. After that, the department neither paid him any suspension allowance nor held any inquiry against him. During his suspension period, Raina also attained his retirement age.Allowing the petition, high court judge, Justice Hakim Imtiyaz Hussain observed that as the respondents were not present and they had not filed any reply, they were proceeded ex-parte. It showed that the respondents had got no objection in allowing this petition. Under these circumstances, the court found that the suspension order was fully unjustified and contrary to rules. With these observations, Justice Hussain set aside the suspension order with the direction that the petitioner should be deemed to have been reinstated. He directed respondents to consider the case for the settlement of period of suspension and grant of pensionary and other retiral benefits in terms of the rules within a period of four weeks.
