| CJM Leh’s dismissal upheld | | | EARLY TIMES REPORT Jammu, May-27 (JNF):- A Third judge of the State High Court upheld the dismissal order of the Chief judicial Magistrate (CJM) Leh. A Division Bench comprising former Chief Justice Barin Ghosh and Justice Sunil Hali differed with each other and the matter referred to the third Judge. Third Judge Justice Mohd Yaqoob Mir upheld the dismissal/ order of removal from service of then CJM Leh on August 29, 2000 with the observation that when the trust and confidence is reposed in the system what is expected of judicial officer is to be exemplary, both in and outside the Court maintaining the highest standard of integrity can be more fragrant cherished by maintaining the highest standard of sophistication behaviour and attitude, small deviation will make it ugly, when such deviation is noticed to be dangerous removal of deviator becomes imperative so as to maintain the magnificence of the institution least tremendous faith imposed by the public in it will get eroded. In the landmark judgment Justice Mohd Yaqoob Mir after hearing the parties further observed that in the final analysis Court have no reason to take a view different to that of Chief Justice, there is no requirement of referring the matter back to the disciplinary authority. As a necessary corollary, the writ petition of then CJM Leh is dismissed. Order of removal from service passed on August 29, 2000 is maintained. With these observations Court allowed the appeal filed by State High Court. JNF JNF/MAY/27/2011/1
