Charas smuggler gets 20 years RI
2 lakh fine imposed

Jammu, May-28 (JNF):- Principal Sessions Judge Kathua Jang Bhadur Singh Jamwal today awarded 20 years rigorous imprisonment and fine Rs 2 lacs each to accused Manzoor Ahmed and Nazir Ahmed u/s 8 (c)/20(c) NDPS Act from whom 96 KG Charas was recovered.
According to the police on July 10, 2006 SHO P/S Raj Bagh Ashok Singh received information that two trucks coming from Srinagar loaded with charas. Driver are smuggling the charas to various states, on this information SHO informed DySP on telephone who met the SHO on the national Highway and put a Naka.
Meanwhile the trucks came there which were signaled to stop, however, he did not stop. The SHO along with DySP and other police officials chased the trucks and at Chhanrorian both the trucks were intercepted. The DySP conducted the search of trucks. Truck No HR55-4547 which was being driven by Nazir Ahmed and from the back side of the driver seat 10 packets containing 2/2 KG each of charas was recovered. The Truck No JK-13-0399 which was being driven by Manzoor Ahmed was also searched and 10 packets containing 2/2 KG each were also recovered and a case u/s 8/18/20/21/22 NDPS Act was registered against the owner of the Truck u/s 29 NDPS Act. The police after investigation enquired from the accused, the accused again narrated that they have the charas in their second cabins also which cannot be opened by easy means and the police thereafter again search the trucks and recovered 15 packets of containing 2 KG each and two packets of charas 3 KG each from the cabin of Truck NO JK-13-0399 and from the cabin other truck bearing No HR55-4547 10 packets containing 2 KG each charas were again recovered, Total Charas weighing 96 KG were recovered and after completion of investigation challan was presented in the Competent Court against accused Manzoor Ahmed s/o Mohd Akbar r/o Naldona Tehsil Shopian, Nazir Ahmed s/o Abdul Ahad r/o Niana Buttpura Tehsil Pulwama, Mohd Abdul Qayoom s/o Mohd Sultan r/o Niana Buttpura Tehsil Pulwama and Bashir Ahmed Dar s/o Mohd Sultan Dar r/o Bijbehara owner of Truck No JK-13-0399 who was declared absconder and proceedings u/s 512 CrPC initiated against him whereas accused Mohd Abdul Qayoom was acquitted from the charges as there was no evidence against him.
The court after hearing Public Prosecutor Bharat Bhushan Sharma appeared for the state whereas Advocates Neelam Sharma and Sushil Gupta appeared for the accused persons awarded 20 years RI with Fine Rs 2 lacs each and in default of payment of fine, he shall suffer imprisonment for a period of five years.
