BJP may write to Speaker for disqualification of suspended MLAs on May 30 | | | Early Times Report JAMMU, May 28: As the factional war in BJP has reached a crescendo with both factions guarding up their loins for a show down to each other, the chances of a patch up between the seven suspended MLAs with the party seem to be remote. The newly appointed BJP Legislative Party leader Jugal Kishore Sharma who has served the disqualification notice to seven suspended party MLAs on the basis of the report of chief whip of the Party Ashok Khajuria accusing them of violating the party whip and voting in favour of NC and Congress candidates in last month's Legislative Council elections has given seven days time to them seeking their reply. According to Party sources after the expiry of seven days time on May 30 Mr Sharma will inform Speaker about the decision of Party and seek the disqualification of all seven members from the House on the basis of law. However the final decision lies with Speaker, Mohammed Akbar Lone as the ball is in his court. However Mr Lone has already assured the suspended six MLAs of the Party who met him recently in the summer Capital that he will not take any decision which will be unconstitutional. With this assurance there is a ray of hope for suspended MLAs that they may get a reprive as Speaker may not dislodge them from the membership of the House on the ground that the majority of the MLAs are with Prof Gupta. But the BJP is rejecting this contention on the ground that after violating the Party whip the seven MLAs as per the new amendment in state constitution have no claim over the membership of the House after the party serves a disqualification notice to them. The BJP sources said that Party has given the seven days time to suspended MLAs before writing the letter to Speaker seeking their dismissal as the same was mandatory as per the constitution and after expiry of the stipulated time, the Party will not lose a single moment in seeking their disqualification from the house. Sources said that the decision regarding serving the notice of disqualification was also taken by Party High Command in New Delhi on the feed back they got from state unit that the suspended MLAs have intensified their anti party activities in the state soon after they were served the suspension notice from the Party last month. Perturbed over the style of functioning of the seven suspended MLAs the High Command without losing any time issued the directives to the state unit asking it to suspend the Party vice president Anil Gupta who happens to be the kin of Prof Chaman Lal Gupta for the anti party activities. Later the party High Command also issued directives to state unit to replace Prof Gupta as BJP LP leader by Jugal Kishore Sharma and later it directed Mr Sharma to serve the disqualification notice to seven MLAs. However the suspended MLAs are optimistic that they will win the legal battle and continue to remain the members of the House as a minority group of four MLAs can't disqualify the majority group of seven MLAs. The Speaker has also to go by the law and our case is fittest in all respects, claim the suspended MLAs.The BJP on the other hand has intensified its campaign against the suspended MLAs and the Party will have no regrets in their disqualification as the members of the House, sources, said, adding they indulged in indiscipline and party can no longer tolerate indiscipline. The Party is firm in its action and the suspended MLAs are liable for the same, the sources said, adding the Assembly Speaker will be given the letter on May 30 positively after the expiry of seven days time to disqualification notice. |
