| HC directs JMC to unseal the banquet hall | | | EARLY TIMES REPORT
Jammu, May-30 (JNF):- The High Court today directed the Jammu
Municipality to unseal Basant Palace banquet hall. Justice JPO Singh
passed the order in a petition filed by the banquet hall.
During the course of arguments Advocate SS Nanda appeared for the
JMC submitted that the petitioner had not obtained license for
operating the banquet hall, as required u/s 328 of Municipal Act and
the Action of the JMC in sealing the banquet hall was strictly in
accodance with the provisions of the Municipal Corporation Act.
Thye Court while clarifying the section 328 observed that the
provisions of Section 328 of MC Act, Court is the prima-facie view
that as the food and drinks are not sold in the banquet hall, so it
may not attract the provision section 328 of the Act and admitted the
petition to hearing, issued notice which was accepted Mr. Nanda for
JMC allowed him four weeks time to file response. JNF
