| HC suspends sentence of three real brothers, grants bail | | | Jammu, Nov 21 Justice Nirmal Singh of J&K High Court Jammu wing in a criminal appeal filed through Advocate Vishal Kapoor against the judgment of Trial Court has suspended the sentence and granted bail to three real brothers. Ghulam Hussain, Mohd Farooq and Mohd Rafiq sons of Mohd Shafi r/o Village Nallah Mallin Tehsil Ramanagar District Udhampur, who were facing trial in murder case of their real brother Sher Ali on land dispute were awarded seven years rigorous imprisonment and a fine Rs 5000/- each by the Trial Court. Justice Nirmal Singh, after hearing Advocate Vishal Kapoor appearing for the appellants and Additional Advocate General Mr. SC Gupta appearing for the state, observed that the applicants have been awarded rigorous imprisonment for seven years with a fine of Rs 5000/- each u/s 304 Part II RPC. Out of the substantive sentence, the applicants have already undergone two years and six months imprisonment and it will take long time for the disposal of the appeal and the record is still awaited, so, without making any comment on the appeal, the sentence of the applicants is suspended and they are directed to be released on bail on furnishing bail bond to the tune of Rs 10,000 each with one surety to the like amount to the satisfaction of the Registrar Judicial High Court Jammu. On the direction of the High Court, the convicts furnished the bail bond and surety bond before the Registrar Judicial High Court, which was accepted and their release order was issued.
