| CJM denies bail to Narcotic Smuggler | | | EARLY TIMES REPORT
Jammu, June-01 (JNF):- Chief Judicial Magistrate Jammu MS Parihar rejected the bail application of one Tarsem Lal of Bishnah who was arrested on May 3, 2011 on alleged committed offence under NDPS Act as 118 capsules have been recovered and seized by the police from the possession of applicant.
CJM Jammu Mr. MS Parihar after hearing Adv Sachin Gupta for the application whereas CPO Pawan Khajuria with PO Rajeshwar Basotra appearing for the state observed that police recovered 118 Pyremol Spas capsule from the possession of the applicant and he was arrested by the police. According to the police report the accused has been arrested u/s 8/21/22 NDPS Act which are exclusively triable by the Special Court. Court is of the view that this Court lacks jurisdiction to entertain and decide the instant application. The police in the report has not mentioned the quantity of the contraband drug recovered and seized from the accused and in absence of the same it cannot be said that the contraband recovered from the possession of the accused is a small quantity or of commercial quantity and dismissed the bail application.
