| Court acquits former SHO in corruption | | | EARLY TIMES REPORT
Jammu, June-02 (JNF) Anti-Corruption Judge AK Koul today acquitted Rajinder Sharma Inspector Police then SHO P/S Sunderbani who was facing trial for the last 8 year for demanding and accepting Rs 85000/-
According to the VOJ case on a written complaint lodged by one Chaman Lal against accused while being posted as SHO P/S Sunderbani alleged that he demanded illegal gratification of Rs 2 lacs from the complainant for extending favour to his brother who was involved in a case u/s 304-A RPC. The complainant said that he could arrange only Rs 85000/- and the paid the same to the alleged accused in presence of witnesses. The alleged accused in spite of receiving bribe money of Rs 85000/- from the complainant did not extent any favour to the brother of the complainant and filed charge-sheet against the brother in the competent court.
The Court after hearing both the sides observed that as per complainant somebody else has demanded and received money and if that is so why has accused been charge-sheeted. The entire evidence read together does lead the court to a conclusion that even a remote nexus between accused and the guilt has not been established. Accused can neither be convicted on the basis of preliminary enquiry conducted by SK Arora nor on the basis of the complaint. Those could only be corroborating factors but there has been some basic evidence to show the complicity of the alleged accused which the court sure is altogether missing. It need not be stated that alleged accused is facing trial on serious charges and so there should have been some convincing evidence to show is complicity but on surfing the entire prosecution evidence, cannot find even an iota of evidence against alleged accused. The basis elements of the offences loaded against the accused are missing. So the only conclusion is that alleged accused is innocent, the case fails, same is dismissed and alleged accused is acquitted from the charges leveled against him. |
