Anti defection law bars courts from interfering in disqualification issue: Speaker | | | Early Times Report Jammu, June 3: Taking note of reports in some section of press regarding issuance of notice to Speaker, J&K Legislative Assembly by High Court on the petition of Chaman Lal Gupta BJP MLA, Speaker Mohammad Akbar Lone has described the action against law and beyond the jurisdiction. In view of the set legal position, Speaker has stated that High Court should have restrained from issuing notice to him, as the case of disqualification of any member of legislature is not admissible under law for legal scrutiny. Speaker explaining legal position of anti- defection law said that Act itself bars courts from interfering in the issue of disqualification of the legislature and everybody is under obligation not to transgress his or her jurisdiction. The Speaker said while he would not like to create a controversy with judiciary but at the same time it was his obligation to uphold the rule of law and dignity of the legislature. He said lawmakers and judiciary should cooperate with each other in making the system strong enough, so that ultimate public interest is served without any upmanship. He said law has defined contours and no one should be allowed to trample upon in the name of dispensing justice. Taking strong of news items in the press he said that media people should not carry news about such notices in future before seeking the comments from the Speaker, because it gives a wrong notion among the general public. |
