| Court awards 3 years RI for attempted rape | | | EARLY TIMES REPORT
Jammu, June-04 (JNF):- The Third Additional Sessions Judge Jammu, Pawan Dev Kotwal today awarded three years rigorous imprisonment and fine Rs 5000/- to accused Ashok Ahmed alias Showkat Ali @ Showki s/o Naseer Ahmed r/o Dhok Waziran Nagrota who was facing trial in attempt to rape with a minor.
According to the police case on April 12, 2004 complainant Neelam Devi lodged a verbal report in P/S Nagrota that on the day when she returned home from her work, she found her daughter aged 6 years missing and she went out for her search, when she reached near the house of accused, she heard cries of her daughter and she entered in the room of the accused, she found that accused attempt to commit rape on her minor daughter and on seen her, accused fled away. On this report police registered a case u/s 376/511 RPC and started investigation and after completion of the investigation presented challan in the Court of law.
While awarding sentence to the accused, the court Additional Sessions Judge Jammu Pawan Dev Kotwal after hearing Additional Public Prosecutor Mr. GS Charak who vehemently opposed the leniency and stress for maximum punishment provided under law. Upon this Court further observed that keeping in view all the attending circumstances and adopting a balanced approach, accused is sentenced to rigorous imprisonment for three years and also fine Rs 5000/-, in case of default of payment of fine accused shall further undergo rigorous imprisonment for six months. The accused who was present in the Court was taken into custody and sent to District Jail Jammu. JNF
